Legal Insurance Liabilities and Responsibilities

Insurance

All technicians must hold (or if an employee, be covered by) at the minimum Public Liability Insurance.  Public Liability Insurance is needed to protect yourself and your Client in the event a claim is made against you.

Depending on your Insurer’s recommendations, it may also be advisable to have product and treatment liability Insurance (sometimes called ‘Medical Malpractice”).  It is recommended that you speak with your Insurance Provider or specialist broker about your individual circumstances to ensue you have the appropriate type and level of cover.

It is critical that you adopt appropriate Accident/Incident reporting and make no statements about your liability to a Client in the event they advise you of a planned claim.  Refer to and always comply with your Insurer’s policy requirements to ensure you are covered.

General

  • As outlined in further sections, where Contra Indications or Contra Actions are suspected, you should not make a diagnosis, but refer your Client to their Doctor for medical advice.
  • It is your responsibility to make yourself aware of and comply with the applicable Local Health & Hygiene, and Work Health & Safety regulations and requirements.  Ignorance is not a defence where a breach occurs, and penalties may apply.
